The Science and CHIPS Act
The CHIPS and Science Act is an economic package meant to inject billions of dollars into semiconductor production and manufacturing in the United States. The act was passed in 2022, targeting modern electronics, from smart phones to medical and US missile devices. The aim is to make America a global, competitive market force. There is a growing demand for qualified workers in these fields, including more skilled immigrants. Immigrant’s make up 17% of the US labor force, and 32% of jobs in the electronics sector. If the field is unable to fill these vital roles, America’s competitiveness may be compromised. Case Study : Dr. Cruz, currently a professor at Emory University, received her PhD three years ago in electronical engineering from the University of Illinois. A Portuguese National, she initially obtained a Masters at a well-known university in Lisbon, and also accumulated numerous certificates and awards in her field. Following her Masters, and before immigrating to the U.S., she was employed with the government of Portugal for a few years, assisting with various high-powered telephone and electronic data centers. During her PhD, Dr. Cruz successfully applied for a patent with her professor on a novel silicon circuit pathway, making electrical flow quicker. The novel idea was the basis of her thesis, and would ultimately make semiconductor manufacturing faster and cheaper. Dr Cruz went on to Emory as head of the electrical engineering lab department, assisting students with their own studies; lab work and intricate understanding of electrical engineering. She also published approximately 7-10 journal articles, and was a speaker at a conference last year. Should Dr Cruz apply for an EB2 (NIW), would she be successful? It is likely that Dr. Cruz would be successful in obtaining an employment-based national interest waiver. While every client’s background and circumstances are different, it seems that Dr Cruz is a good candidate for an EB2, particularly in light of the need for more skilled workers under the CHIP and Science Act. She has a PhD in a STEM field; a patent on a novel design; has published 7-10 articles; obtained awards and certificates in her field; and was a speaker at a conference last year.
